Welcome to Nova Terra Realty ("Company", "we", "our", "us"). These Terms and Conditions ("Terms") govern your use of this website, on which we advertise a seasonal rental residence in Wellen Park, Venice, Florida, and submit inquiries about it (the "Service").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. They apply to all visitors and users. Please read them carefully before using the Service.
Submitting the inquiry form does not reserve the residence and does not create a lease, a rental agreement or any other contract. It is a request for information. A rental exists only once both sides sign a written lease and the required payments have been made.
Nothing on this website is an offer that can be accepted by submitting a form. We may decline any inquiry. No payment is requested or accepted through this website, and we do not ask for card or bank details here. There are no user accounts on this website.
The advertised rate, taxes, fees, minimum stay, availability, what the community does and does not include, and how photographs should be read are set out on our Rental Terms & Disclosures page, which forms part of these Terms. In short: the rate is per residence and shown before tax, the minimum stay is 30 days, golf is not included with this residence, and interior photographs may show a model residence.

Nova Terra Realty is not affiliated with, endorsed by or sponsored by Wellen Park, Wellen Park Golf & Country Club, or their developers or associations.
When you submit the inquiry form we will reply by email, and by phone if you have given us a number. Consent to receive text messages is given by ticking the optional box on the form; it is never pre-ticked, and it is not a condition of renting. Reply STOP at any time to stop messages, or HELP for help. Full SMS terms are in section 12 below.
You agree that the information you submit is accurate and that the contact details you give are your own or ones you are authorised to provide. Do not use the inquiry form for advertising, bulk messaging or any unlawful purpose. How we handle what you send is set out in our Privacy Policy.
The Service and its original content, features and functionality — including the text and photographs on this website — are and will remain the exclusive property of Nova Terra Realty and its licensors. Please do not copy or republish them.
Our Service may contain links to third-party web sites or services that are not owned or controlled by Nova Terra Realty. We have no control over, and assume no responsibility for, the content, privacy policies or practices of any third-party web sites or services, and we do not warrant their offerings.
We keep this website as accurate as we can but do not warrant that it is complete, current or error-free, and it may be changed or taken down at any time. Rates, availability, fees and amenities may change until a signed lease is in place. Where this website and a signed lease differ, the lease governs.
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We disclaim liability for third-party content, including links.
You agree to defend, indemnify and hold harmless Nova Terra Realty and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.
In no event shall Nova Terra Realty, nor its directors, employees, partners, agents, suppliers or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation loss of profits, data, use, goodwill or other intangible losses, resulting from: (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you. Nothing in these Terms limits any liability that cannot be limited under applicable law.
These Terms shall be governed by the laws of Illinois, US, without regard to conflict of law provisions. Any lease for the residence is governed by its own terms and by Florida law.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
